Introduction

These terms and conditions govern the sale of original artworks ("Artwork") by John Collingwood through its website www.johncollingwood.com. By purchasing Artwork from John Collingwood, you agree to comply with and be bound by these terms and conditions.

Artwork Description & Availability

  • Description: John Collingwood strives to provide accurate descriptions and images of the artwork on its website. Please note that colours and dimensions may slightly vary from the actual Artwork due to individual monitor settings and the nature of original pieces.

  • Availability: Artwork availability is subject to change without prior notice. In the event that an Artwork becomes unavailable after an order is placed, John Collingwood will notify the purchaser and provide alternatives or a refund.

Order Confirmation & Acceptance

  • Price on Request: For Artwork listed as "price on request" on the website, an email will be sent with the pricing information upon request. Confirmation of this information does not signify acceptance of the order but indicates that the request has been received.

  • Acceptance: Acceptance of an order occurs when John Collingwood dispatches the Artwork. A dispatch confirmation email will be sent at that time.

Pricing & Payment

  • Pricing: The prices displayed for Artwork are in GBP. Shipping charges are additional and will be mutually agreed upon with the Purchaser beforehand.

  • Payment: Full payment must be received within seven days of receipt of the Sales Invoice to secure the Artwork.

Delivery & Shipping

  • Delivery: John Collingwood aims to dispatch Artwork within the specified timeframe. Delivery times may vary based on the destination. Any delays due to unforeseen circumstances will be communicated promptly.

  • Shipping Address: It is the purchaser's responsibility to provide an accurate and complete shipping address.

  • Delivery Receipt: Upon receipt of the Artwork, the purchaser or designated recipient must inspect the package for any damage or discrepancies. Any issues must be reported to John Collingwood within 48 hours of delivery.

  • Import Duties & Taxes: Kindly be informed that the purchaser bears the responsibility for any import duties or taxes incurred regarding their Artwork shipment.
Returns & Refunds

  • Returns: John Collingwood accepts returns of Artwork only if they arrive damaged or differ significantly from the description. To initiate a return, contact John Collingwood within 7 days of receiving the Artwork.

  • Refunds: Refunds for returned Artwork will be processed once the item is received by John Collingwood and assessed for damages or discrepancies. Refunds will be issued using the original payment method.

Intellectual Property Rights

  • Ownership: The purchase of Artwork does not transfer any intellectual property rights. All copyrights and reproduction rights remain with John Collingwood.

  • Use of Artwork: The purchaser may not reproduce, distribute, or use the Artwork for commercial purposes without explicit permission from John Collingwood.

Storage Charges
  • Storage: Artwork(s) will be stored free of charge for a period of sixty days. After this time, any unpaid or unshipped Artwork(s) will incur storage charges, for which the Purchaser will be liable. Storage charges will be based on £6.50 per cubic metre per week, equivalent to £28.00 per calendar month.
Title, Risk, & Insurance
  • Title and Risk: Title to the Artwork(s) will pass to the Purchaser only on full receipt of the Sales Invoice total by cleared funds. The Purchaser shall be responsible for the Artwork(s), and risk shall pass to the Purchaser. Therefore, appropriate arrangements to insure the Artwork(s) must be made by the Purchaser from this time.
Governing Law & Jurisdiction
  • Jurisdiction: These terms and conditions are governed by the laws of England and Wales. Any disputes arising from the sale of Artwork will be subject to the non-exclusive jurisdiction of the English courts.
